PROTECTIVE JURISDICTION INTERNATIONAL LAW

Protective principle of jurisdiction, International Law visualized.

The protective or security principle of jurisdiction, is recognized in International Law as the state's right to punish certain offenses committed abroad by non-nationals, crimes against the state security, or other crimes recognized by developed legal systems threatening the integrity of governmental functions, like espionage, counterfeiting of the state's seal or currency, falsification of official documents, perjury before consular officials, and conspiracy to violate the immigration or customs laws.

The protective principle is a special application of the effects principle, but it has been treated as an independent
basis of jurisdiction.

The principle has been deployed by the American
District Court in relation to the exercise of jurisdiction over terrorist offenses committed abroad, like the bombing of the American embassies in Kenya and Tanzania in 1998.
